Distance Selling Agreement

By accepting this agreement, the BUYER acknowledges and agrees in advance that if they approve the order subject to the contract, they will be obliged to pay the cost of the order and any additional fees such as shipping costs, taxes, and that they have been informed about this matter.

2. DEFINITIONS

In the application and interpretation of this contract, the terms written below shall refer to the written explanations opposite them.

  • MINISTER: The Minister of Customs and Trade,

  • LAW: Law No. 6502 on the Protection of Consumers,
  • REGULATION: The Regulation on Distance Contracts,
  • SERVICE: Any consumer transaction other than the provision of goods, made or promised to be made for a fee or benefit,
  • SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities, or acts on behalf or account of the goods provider,
  • BUYER: A real or legal person who acquires, uses or benefits from a good or service for non-commercial or non-professional purposes,
  • SITE: The SELLER's website,
  • ORDERER: A real or legal person who orders a good or service through the SELLER's website,
  • PARTIES: The SELLER and the BUYER,
  • AGREEMENT: This agreement executed between the SELLER and the BUYER,
  • GOODS: Movable property subject to trade and intangible goods such as software, audio, video and similar prepared for use in electronic environment,

3. SUBJECT

This Agreement regulates the rights and obligations of the parties in accordance with the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts, regarding the sale and delivery of the product, whose qualities and sales price are specified below, which the BUYER has ordered electronically through the SELLER's website.

The prices listed and advertised on the site are sales prices. The advertised prices and promises are valid until updated and changed. Prices advertised for a limited period are valid until the end of the specified period.

7. PRODUCT/PRODUCTS SUBJECT TO THE AGREEMENT INFORMATION

1. The basic features of the goods/products/services (type, quantity, brand/model, color, number) are published on the SELLER's website. If the seller has organized a campaign, you can examine the basic features of the relevant product during the campaign period. Valid until the campaign date.

7.2. Prices

The prices listed and advertised on the site are sales prices. The advertised prices and promises are valid until updated and changed. Prices advertised for a limited period are valid until the end of the specified period.

7.3. Taxes and Payments

The sales price of the goods or services subject to the contract, including all taxes, is shown below.

7.4 The Seller has offered a payment method to the BUYER.
- If the BUYER purchases a Service or Product through the Website, payment can be made via the Iyzico online payment application.

9. GENERAL PROVISIONS

9.1. Information and Acceptance

The BUYER accepts, declares, and undertakes that they have read the preliminary information regarding the basic qualities, sales price, payment method, and delivery of the product subject to the contract on the SELLER's website, that they have knowledge thereof, and that they have given the necessary confirmation electronically.

9.2. Delivery Period

Each product subject to the contract shall be delivered within the period specified in the preliminary information section of the website, depending on the distance of the BUYER's residence, not exceeding the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

In case the distance contract relates to the sale of goods, the BUYER may exercise their right of withdrawal by refusing the goods without showing any reason, provided that they notify the SELLER within 14 days from the date of delivery of the product to themselves or to the person/organization at the address indicated by them.

11. PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Products prepared in line with the BUYER's requests or explicit personal needs, such as underwear bottom pieces, make-up materials, disposable products, are excluded from the scope of the right of withdrawal.

12. DEFAULT AND ITS LEGAL CONSEQUENCES

If the BUYER defaults in the event of making payment by credit card, they accept, declare and undertake that they will pay interest within the framework of the credit card agreement between them and the cardholder bank and will be liable to the bank.

13. AUTHORIZED COURT

In disputes arising from this contract, complaints and objections will be made to the consumer arbitration committee or consumer court in the place of residence of the consumer or where the consumer transaction took place.

14. EFFECTIVE DATE

The BUYER is deemed to have accepted all terms of this agreement when they complete the payment for the order placed through the Site.
