Cancellation and Refund Conditions

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION RETURN CONDITIONS

GENERAL:

  1. If you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract provided to you.
  2. Buyers are subject to the provisions of the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they have purchased.
  3. Shipping costs for product shipments will be paid by the buyers.
  4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, Buyers can terminate the contract.
  5. The purchased product must be delivered completely and in accordance with the specifications stated in the order, along with any warranty certificate and user manual, if available.
  6. If it becomes impossible to sell the purchased product, the seller must notify the buyer of this situation in writing within 3 days of learning about it. The total price must also be refunded to the Buyer within 14 days.

 

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the Buyer does not pay for the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ends.

 

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. If, after the product is delivered, it is determined that the credit card used by the buyer for payment has been used unfairly by unauthorized persons and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the contract to the SELLER within 3 days, with the shipping costs belonging to the SELLER.

 

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If unforeseen force majeure events occur for the Seller and the product cannot be delivered on time, the Buyer will be notified. The Buyer may request cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this fee will be paid in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels it, the product price will be refunded to the bank within 14 days from this cancellation, but it is possible for the bank to transfer it to the buyer's account within 2-3 weeks.

 

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The Buyer shall inspect the goods/services subject to the contract before receiving them; dented, broken, torn packaging, etc. damaged and defective goods/services will not be received from the cargo company. It will be accepted that the received goods/services are undamaged and sound. The BUYER must protect the goods/services carefully after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The invoice must also be returned with the product.

 

RIGHT OF WITHDRAWAL:

  1. The BUYER may exercise the right to withdraw from the contract by rejecting the goods without incurring any legal or penal liability and without stating any reason, provided that the SELLER is notified through the contact information below within 14 (fourteen) days from the date of delivery of the purchased product to him/her or to the person/organization at the address indicated.

PERIOD OF RIGHT OF WITHDRAWAL:

  1. If the purchased item is a service, this 14-day period begins from the date the contract is signed. The right of withdrawal cannot be exercised in service contracts where the performance of the service has begun with the consumer's consent before the withdrawal period expires.
  2. The costs arising from the exercise of the right of withdrawal belong to the SELLER.
  3. To exercise the right of withdrawal, it is mandatory to provide written notification to the SELLER via registered mail, fax, or email within 14 (fourteen) days and for the product not to have been used within the scope of the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions stipulated in this contract.

 

EXERCISING THE RIGHT OF WITHDRAWAL:

  1. The invoice for the product delivered to the third party or the BUYER, (If the invoice for the product to be returned is corporate, it must be sent with the return invoice issued by the company. Order returns for which invoices are issued in the name of corporations cannot be completed if a RETURN INVOICE is not issued.)
  2. The return form, the box, packaging, and any standard accessories of the products to be returned must be delivered completely and undamaged.

 

RETURN CONDITIONS:

  1. The SELLER is obliged to refund the total amount and the documents that put the BUYER into debt to the BUYER within a maximum of 10 days from the receipt of the withdrawal notification and to take back the goods within 20 days.
  2. If there is a decrease in the value of the goods due to a fault of the BUYER or if return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to his fault. However, the BUYER is not responsible for changes and deteriorations caused by the proper use of the goods or product within the right of withdrawal period.
  3. If the campaign limit amount organized by the SELLER falls below the limit due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign will be cancelled.

 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. It is not possible to return goods prepared in line with the BUYER's request or explicit personal needs and not suitable for return, such as lower parts of underwear, swimwear and bikini bottoms, make-up products, disposable products, goods that are likely to deteriorate quickly or expire, products that are unsuitable for return for health and hygiene reasons if their packaging is opened by the BUYER after delivery, products that are mixed with other products after delivery and cannot be separated due to their nature, goods related to periodic publications such as newspapers and magazines, excluding those provided under subscription contracts, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and in case the BUYER has opened the packaging of audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables. In addition, it is not possible to exercise the right of withdrawal for services whose performance has started with the consumer's consent before the end of the right of withdrawal period, as per the Regulation.
  2. For cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returnable, their packaging must be unopened, untried, undamaged, and unused.

 

DEFAULT AND LEGAL CONSEQUENCES

  1. If the BUYER defaults on payment transactions made by credit card, he/she accepts, declares, and undertakes that he/she will pay interest within the framework of the credit card agreement with the card-issuing bank and will be responsible to the bank. In this case, the relevant bank may resort to legal remedies; it may demand the resulting expenses and attorney's fees from the BUYER, and in any case, if the BUYER defaults on his/her debt, the BUYER accepts that he/she will compensate the SELLER for the loss and damage incurred due to the delayed fulfillment of the debt.

  1. You can make a bank transfer or EFT (Electronic Funds Transfer) to any of our Yapı Kredi, Garanti, and Halkbank bank accounts (in TL).
  2. You can benefit from online single payment or online installment options with your credit cards through our website. For your online payments, the amount will be charged from your credit card at the end of your order.
